Why institutions abroad ask for a death certificate

Four situations account for most requests:

• An inheritance case abroad. If the deceased owned property, accounts, or company shares in another country, the local notary or court opens an estate case and requires the death certificate with a translation — and in most cases with an apostille.
• Pensions and social benefits. To stop the deceased’s pension payments or to claim survivor benefits in another country, the relevant fund asks for official confirmation of death with a translation.
• Insurance payouts. Foreign insurers decide on payouts only on the basis of a certified translation of the certificate; medical records are often requested in addition.
• Remarriage. A widow or widower marrying abroad proves the termination of the previous marriage precisely with the spouse’s death certificate.

Each of these procedures has its own certification requirements, so before ordering it is worth confirming with the institution whether a notarized translation is sufficient and whether an apostille is needed.

The reverse situation: the death occurred abroad, the case is in Ukraine

Just as often, clients bring us a foreign death certificate that must be presented to a Ukrainian notary — most commonly to open an inheritance case in Ukraine. In that scenario we translate the document into Ukrainian with notarization, but first we check whether it is ready to be used: depending on the issuing country, it must carry an apostille or consular legalization — or is accepted without further certification where a legal assistance treaty applies between the countries. The medical certificate of death is not the right document

This is a common mix-up that costs time. The medical certificate of death is issued by a healthcare institution; it is the medical document on the basis of which the civil registry records the death. Foreign notaries, funds, and insurers work with the death certificate issued by the civil registry office (RACS) on the official state form — that is the document to translate. If the death has not yet been registered, the registry certificate is obtained first, and the translation is ordered after. The medical certificate itself sometimes needs translating too — mainly for insurance companies, as an annex to the main package.

A death certificate rarely travels alone: the document chain for inheritance

In inheritance cases the death certificate is almost never filed on its own. To prove kinship with the deceased, the notary asks for birth certificates, marriage certificates, and sometimes name-change certificates. We translate the whole set as a single project, and there is a practical reason for it: the spelling of names must be identical across every document and must match the heirs’ international passports. If an heir’s surname is transliterated one way in one document and differently in another, the institution may doubt that both refer to the same person. Apostille, old forms, and lost certificates

Apostilles on certificates issued by Ukrainian civil registry offices are placed by the Ministry of Justice of Ukraine. The correct order is: apostille on the original first, then translation — so the apostille stamp is translated as well and the package does not have to be redone. A separate scenario involves Soviet-era, laminated, or lost certificates. Ukraine does not apostille old or laminated forms, so for use abroad a re-issued certificate from the civil registry on the current form must be obtained first. Relatives of the deceased are entitled to request a re-issued death certificate; if you are abroad, this is arranged by power of attorney or through a consulate.
